(This is a sample of the contract that will be signed by both parties)
This contract is entered into on the date of acceptance, by and between the individual and/or business requesting the Appraisal, hereinafter referred to as the “Client,” and Casey Edinger of Cirrus Equine Appraisals, hereinafter referred to as the “Appraiser,” who mutually agree to the following terms and conditions:
The Client requests that the Appraiser prepare an Appraisal on the subject Equine. The Appraisal is only for use by the Client and other interested parties divulged prior to completion of the Appraisal. In the event that the Appraiser is requested to appear in court regarding this Appraisal or the subject Equine of this Appraisal, the Appraiser reserved the right to negotiate any fees associated with such court appearance. No responsibility is assumed for the outcome of any legal action in which this Appraisal might be used as evidence. In the event that an on-site inspection of the Equine is not possible, it is assumed that the animal is sound and healthy.* If it is not possible to conduct an on-site investigation of the subject Equine, the Client is responsible for providing all required documentation, including records, photographs and/or videos, and a veterinary certification of health and soundness that is no more than seven (7) days old. Cirrus Equine Appraisals will prepare the Appraisal Report in accordance with USPAP standards. The Client will receive three (3) copies of the Appraisal Report.**
*A veterinary certificate of health and soundness is not required in situations where the subject Equine is deceased and a retrospective Appraisal is performed.
**Additional copies of the Appraisal Report may be requested for an additional $10/Report.
The Client agrees to pay the Summary Appraisal Report fee of $300. Half of the appraisal fee ($150) is required to begin work on the appraisal. The on-site inspection is included in the appraisal fee, with a traveling distance of 125 miles from Dameron, Maryland. Additional mileage is charged at $0.45/mile. The remainder of the appraisal fee and any additional mileage or other costs (discussed with the Client) is due upon receipt of the completed Appraisal Report. Fees for Other Billable Events are due in advance of any services being rendered. Payment past due thirty (30) days will be considered in default, and the Appraiser is entitled to exercise all legal remedies available to collect the amount due at the Client’s expense.
The signatures of the individuals (and/or corporate representatives) on this contract indicates that the Client understands and accepts the terms and conditions as they are stated above. This contract constitutes the entire agreement between the parties involved.
